Privacy Policy

This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or collected by us, when interacting with you — including through the Folio Suite platform.

The information we collect

Personal information is information or an opinion, whether true or not and whether recorded in a material form or not, about an individual who is identified or reasonably identifiable.

The types of personal information we may collect about you include:

  • Identity Data: including your name, age and gender.
  • Contact Data: including your telephone number, address and email.
  • Financial Data: including bank account and payment card details (through our third-party payment processor, which stores such information, and we do not have access to that information).
  • Transaction Data: including details about payments to and from you, and other details of products and services you have purchased from us or we have purchased from you.
  • Technical and Usage Data: when you access any of our websites or platforms — your internet protocol (IP) address, login data, browser session and geo-location data, statistics on page views and sessions, device and network information, acquisition sources, search queries and/or browsing behaviour, access and use of our website (including through cookies or analytics), and communications with our website.
  • Photographic content: images and album metadata that photographers upload to their galleries, and the favourites clients mark, stored so we can provide the galleries.
  • Interaction Data: including information you provide when you participate in any interactive features, surveys, contests, promotions, activities or events.
  • Marketing and Communications Data: including your preferences in receiving marketing from us and our third parties, and your communication preferences.
  • Professional Data: where you are a worker of ours or applying for a role with us, your professional history.
  • Sensitive Information: a subset of personal information given a higher level of protection — information relating to your racial or ethnic origin, political opinions, religion, professional associations, philosophical beliefs, sexual orientation or practices, criminal record, health or biometric information. In the course of doing business with you, we may collect or come across such information in different situations.

How we collect personal information

We collect personal information in a variety of ways, including:

  • when you provide it directly to us — face-to-face, over the phone, over email, or online;
  • when you complete a form, such as registering for events or newsletters, or responding to surveys;
  • when you use any website or platform we operate (including from analytics and cookie providers or marketing providers — see "Cookies" below);
  • from third parties; or
  • from publicly available sources.

Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose your personal information for the following purposes:

  • to provide the Folio Suite service — hosting galleries, authenticating photographers and their clients, and recording favourites;
  • to do business with you, including managing your appointments;
  • to contact and communicate with you about our business, including responding to support requests and enquiries;
  • for internal record keeping, administrative, invoicing and billing purposes;
  • for analytics, market research and business development, including to operate and improve our business and associated platforms;
  • if you have applied for employment with us, to consider your application; and
  • to comply with our legal obligations or as otherwise required or authorised by law.

Sensitive information. We only collect, hold, use and disclose sensitive information: for any purpose you consent to; for the primary purpose for which it was collected; for directly related secondary purposes; to contact emergency services or your support people where we reasonably believe there is a serious risk to life, health or safety and it is impracticable to obtain your consent; and if otherwise required or authorised by law.

Our disclosures of personal information to third parties

We may disclose personal information to third parties where necessary as part of our business, where we have your consent, or where permitted by law, including to:

  • our employees, contractors and/or related entities;
  • IT service providers, data storage, web-hosting and server providers;
  • marketing or advertising providers;
  • professional advisors, bankers, auditors, insurers and insurance brokers;
  • payment systems operators or processors;
  • our existing or potential agents or business partners;
  • a purchaser or successor entity, if we merge with or are acquired by another company or sell our assets;
  • courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, or to establish, exercise or defend our legal rights; and
  • any other third parties as required or permitted by law, such as in response to a subpoena.

We will only disclose sensitive information with your consent or where permitted by law.

Photographer and client data

Where a photographer uses Folio Suite to share galleries with their own clients, the photographer decides who may access their galleries and what client information (such as a client's name and email) is stored to provide that access. We host this information on the photographer's behalf. If you are a client, the photographer who invited you manages your access — please direct requests about your information to them in the first instance.

Google Analytics

We may use Google Analytics, including Advertising Features. We and third-party vendors may use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as Google advertising cookies) together. These may collect Technical and Usage Data about you. You can opt out using the Google Analytics Opt-out Browser add-on, and manage personalised advertising via Google's Ads Preferences Manager.

Overseas disclosure

We store your personal information in Australia. Where we disclose your personal information to third parties, those third parties may store, transfer or access it outside of Australia, including but not limited to New Zealand. We will only disclose your personal information overseas in accordance with the Australian Privacy Principles.

Your rights and controlling your personal information

Your choice. If you provide personal information to us, you understand we will collect, hold, use and disclose it in accordance with this Privacy Policy. You do not have to provide personal information to us, however if you do not, it may affect our ability to do business with you.

Information from third parties. If we receive personal information about you from a third party, we will protect it as set out in this Policy. If you provide personal information about someone else, you represent that you have their consent to do so.

Restrict and unsubscribe. To opt out of marketing communications, contact us using the details below or use the unsubscribe facility in the communication.

Access. You may request access to the personal information we hold about you. An administrative fee may be payable. In some situations we may be legally permitted to withhold access, in which case we will tell you why.

Correction. If you believe information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, contact us and we will take reasonable steps to correct it.

Complaints. If you wish to make a complaint, contact us with full details. We will investigate and respond in writing. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner.

Storage and security

We are committed to ensuring the personal information we collect is secure. We have put in place suitable physical, electronic and managerial procedures to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. While we are committed to security, we cannot guarantee the security of information transmitted to or by us over the Internet — transmission is at your own risk.

Cookies

We may use cookies from time to time. Cookies are text files placed in your browser to store your preferences. By themselves, cookies do not tell us your email address or other personally identifiable information, but they recognise you when you return. You can block cookies via your browser settings, however if you block all cookies (including essential cookies) you may not be able to access all or parts of our website.

Links to other websites

Our website may contain links to other parties' websites. We do not have control over those websites and are not responsible for the protection and privacy of any personal information you provide while visiting them. Those websites are not governed by this Privacy Policy.

Amendments

We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended version. We recommend you check this page regularly to ensure you are aware of our current Privacy Policy.
